Please read these Terms of Service ("Terms") carefully before using the PDFika mobile application ("App") operated by BarisTechApps ("we", "us", or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 18 years of age to use PDFika. By using the App, you represent and warrant that you meet this requirement. If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Account Registration

To access certain features of the App, you may be required to create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your password and account credentials
• Promptly notify us of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate your account if any information provided is found to be inaccurate, false, or in violation of these Terms.

3. Description of Service

PDFika is a mobile application that provides PDF management tools, including but not limited to: merging, splitting, compressing, rotating, adding text, signing, and AI-powered summarisation of PDF documents. Some features are available for free; others require an active premium subscription.

4. Subscriptions and Payments

PDFika offers optional premium subscription plans that unlock additional features. By subscribing, you agree to the following:

• Billing: Subscriptions are billed on a recurring basis (monthly or yearly) through the Apple App Store or Google Play, depending on the platform where you purchased the subscription. Your payment method is charged by the relevant storefront at the start of each billing period.
• Auto-renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
• Price changes: We reserve the right to change subscription prices. You will be notified in advance of any price changes and given the opportunity to cancel before the new price takes effect.
• Refunds: Refund eligibility is determined by the storefront through which you purchased the subscription and by applicable law.
• Cancellation: You may cancel your subscription at any time through your App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period; you retain access to premium features until then.

5. Free Tier Limitations

Free accounts are subject to usage limits, including but not limited to the number of AI summarisation requests per month. We reserve the right to modify these limits at any time with reasonable notice.

6. Your Content and Files

You retain full ownership of all files and documents you process through PDFika. By using the App, you grant us a limited, temporary license to process your files solely for the purpose of delivering the requested service.

• Files are transmitted to our servers only for processing and are deleted immediately after the operation is complete.
• We do not claim ownership of your files and will not use them for any purpose other than performing the requested operation.
• You are solely responsible for the content of the files you process. You must not upload files that contain illegal, infringing, or harmful content.

7. Prohibited Uses

You agree not to use PDFika to:

• Violate any applicable local, national, or international law or regulation
• Infringe upon the intellectual property rights of others
• Upload, process, or distribute malware, viruses, or any other harmful software
• Attempt to reverse engineer, decompile, or disassemble the App
• Use the App for any fraudulent, abusive, or unauthorized purpose
• Circumvent or attempt to bypass any usage limits, authentication mechanisms, or security features
• Resell, sublicense, or redistribute the App or its features without our express written permission

8. Intellectual Property

The App, including its design, source code, graphics, logos, and all associated content, is the exclusive property of BarisTechApps and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

Nothing in these Terms grants you any rights to our trademarks, trade names, or other intellectual property.

9. Third-Party Services

PDFika integrates with third-party services including Firebase (Google LLC), Google Gemini (Google LLC), Apple App Store services, and Google Play services. Your use of these services is subject to their respective terms of service and privacy policies. We are not responsible for the practices or content of any third-party services.

10. Disclaimer of Warranties

PDFika is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.

We do not guarantee the accuracy or completeness of AI-generated summaries. AI features are provided as a convenience tool and should not be relied upon as a substitute for reading the original document.

11. Limitation of Liability

To the maximum extent permitted by applicable law, BarisTechApps shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or loss of business, arising out of or in connection with your use of the App, even if we have been advised of the possibility of such damages.

Our total liability to you for any claims arising from your use of the App shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless BarisTechApps and its affiliates, officers, and employees from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your use of the App, your violation of these Terms, or your infringement of any third-party rights.

13. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for any reason, including if we reasonably believe you have violated these Terms. Upon termination, your right to use the App ceases immediately. Provisions of these Terms that by their nature should survive termination (including intellectual property, disclaimer of warranties, and limitation of liability) shall survive.

14. Changes to These Terms

We may update these Terms from time to time. When we make changes, we will update the "Last updated" date at the top of this page. Continued use of the App after changes become effective constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

15. Governing Law

These Terms are governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the competent courts.
